A escura historia da miña denuncia á APPF por correo electrónico (i)

Já se sabe. O 27 de Agosto presentei umha reclamaçâo ao Provedor de Xustiza Europeu, onde é possivel abrir uma conta, de facto, quatro queixas, que Tina Nilsson aparentemente resume num único processo, uma queixa 1585/2024/AGU, ver abaixo,  (EOWEB_COMPLAINT_ID: 47674), contra á Autoridade para Partidos Políticos Europeos e Fundacions Políticas Europeas.

Alegaba que achara “cousas incompreensiveis” nos painéis en que INDRA transmitiu “en tempo real” os resultados das eleccións do 10 N 2019, posteara las anomalias nas entradas (LXXX) e (LXXXI) deste blog, que a Unión Europea descuidaba a “tremenda irregularidade coa que opera[ba]n practicamente a totalidade dos partidos políticos en Espanhaa”, e que e a Autoridade para Partidos Políticos Europeos etc. agía incorrectamente “non exercendo ningún control nin sobre a actividades, os programas, etc, etc. dos partidos politicos españois nin sobre os procedimentos electorais no Reino de Espanha”. Incluia como reforço na reclamaçao un texto en que falaba dás alcunhas que pasaron a formar parte da vida da miña dona e mia desde que fora banido do meu posto de trabalho no IES nº 1 de Ordes, alcunhas repetitivas, um chato para cacete, e como arquivo anexado numa mensagem que adicionei ums días despois, un longo “chat”, uma longa conversaçao electrónica con ChatGPT 4o sobre INDRA. O que solicitaba era que se investigasse o assunto. Como é meu hábito, enviei este texto para vários locais, um endereço do presidente emérito Carlos Puigdemont, um endereço do Bloque Nacionalista Gallego, e um sitio admirável, o Arquivo da Transiçâo.

Vinte e um días despois, o 18 de Setembro de 2024, o e tarde, Tina Nilsson, do Gabinete do Provedor de Justiça Europeu, assina uma decisão desse gabinete na que resume o contido dos meus desvarios, é o que pensa nesta cidade todo o mundo, parece entendelos e sinala que ainda não me dirigi diretamente às instituições contra as quais apresento as minhas queixas, a Comissão Europeia e Autoridade para os Partidos Políticos Europeus e as Fundações Europeias, 4 reclamacoes, e que quando o fizer, se observasse atrasos ou ficasse insatisfeito, voltaria a recorrer ao Provedor de Justiça Europeu.

Foi mais ou menos a mesma coisa, com mais empatia, encorajando-me, ou não, a continuar com o que vou tentar postar na próxima entrada, será a terceira entrada da já terceira página da principal, como duzentos e vinte e seis, uma grave violação da lei na União Europeia desde a sua fundação, a ideia, que veio através de um sinal do Professor Philip Bradford Stark, da universidade de Berkeley e a intervenção certamente  diabolica, sob  suspeita, de alguns correspondentes no Gana, alguns vigaristas que sinceramente não entendo, de que nunca houve partidos políticos, nin democracia verificavel, na União Europeia desde a sua fundação, em duas fases, primeiro como CEE, Comunidade Económica Europeia, em 25 de março de 1957, através da assinatura do Tratado de Roma, aplicado a partir de 1 de janeiro de 1958, e depois oficialmente como União Europeia (UE) a partir de 1 de novembro de 1993, com a entrada em vigor do Tratado de Maastricht, assinado  em 7 de fevereiro de 1992, pouco menos de dois anos antes … pouco mais ou menos, pero con mais empatia, que o que me respondeu Teresa Jimenez Becerril – Barrio, o primeiro deputado do Provedor de Justiça espanhol, Angel Gabilomdo, em 5 / 08 / 2022, respondendo à minha queixa, mais ou menos sobre a mesma coisa, a intervenção da INDRA SYSTEMS nos processos eleitorais do Reino de Espanha, desde, eram os meus cálculos, o ano 2008, durante a presidência de Mariano Rajoy Brey, dirigidonme en primeira instancia ao artigo 20º da LOREG 5/1985, cito o artigo abaixo em traduçâo portuguesa:

Os eleitores apresentarão as suas consultas à Junta Eleitoral Zonal correspondente ao seu local de residência.

Os partidos políticos, associações, coligações ou federações e grupos de eleitores podem apresentar consultas à Junta Eleitoral Central quando se trate de assuntos de carácter geral que possam afetar mais do que uma Junta Eleitoral Provincial. e acrescentando duas linhas antes do fim: “Se, uma vez iniciados estes procedimentos, verificar atrasos ou qualquer outra irregularidade pode dirigir-se de novo a esta instituição, afirmando por escrito essas circunstâncias.”

Em todo o caso, de acordo com a carta de notificação assinada por Tina Nilsson, que assina como Chefe da Unidade de Tratamento de Casos do, de resto, eterno gabinete do Provedor de Justiça Europeu, nove dias depois de ter sido notificado desta decisão, em 27 de setembro de 2024, tentei contactar a APPF, enviando-lhe um texto que tinha previamente redigido, até quatro vezes, tenho muitos problemas com o correio,  às Naçôes Unidas, ao Alto Comissariado para os Direitos do Homem. O e-mail, com texto, conteúdo e forma, preparados com a ajuda de uma daquelas aplicaçôes de Inteligencia Artificial que Elon Musk e o projeto Open AI puseram à disposiçao do Mundo, e nâo devolvido por el sistema foi este:

Two weeks ago I submitted a complaint to the European Ombudsman about the lack of control by the European Institutions related to the activity of European Political Parties. Elections in Spain are always a mess and that happens because there’s no valid framing for conducting any election. The European Ombudsman told me to contact first those European Institutions I mentioned and, in a second stage, to reword my query.
This is a summary of my view.
I’d like your office gave a creative answer.
In the March 1 2009  Election to the Parliament of Galicia I had a bad experience trying to challenge the reported results of the first win, absolue majority of Alberto Nuñez Feijoo as a President of the Galician Government, Xunta de Galicia.

At last that drove me, through a not too long process, to a forced psychyatrical admission by a Court Order and, after thatm to a Court Sentence of disability.

Since then I’ve beeen interested in LOREG 5/1985, Ley Orgánica de Régimen electoral General, that sets the frame for elections in Spain. Many peopple think this law poses a problem. The first person that mentioned LOREG 5/1985 was Mr. Nestor Rego Candamil, now a deputy of the Galician Nationalist Bloc  in the Spanish Congress in this XV Legislature, .

I think LOREG 5/1985 provides an inadequate, obsolete framing for conducting genuine elections in the Spanish Kingdom. This been so for years.

LOREG 5 / 1985  came in force on June 21st 1985, under the presidency of Felipe González Márquez and copies in the main of its regulations a Francoist, Royal Law Decree 20/1977  March 18th 1977, on electoral regulations. Like this Royal Law Decree 20/1977 March 18th 1977, the LOREG 5/1985 imposes two obligations that must be imperatively obeyed in every election held in Spain:

i) Both impose the drestruction of ballots:

The ballots taken from the ballot boxes shall be destroyed in the presence of those present, with the exception of those which have been denied validity or which have been the object of a complaint, all of which shall be attached to the minutes, once initialed by the members of the Table, and shall be filed with the same.

ii) Both the Royal Law Decree 20/1977 of March 18th on electoral regulations (under TITLE II – Electoral Organization –  CHAPTER ONE: The Electoral Roll and the Electoral Boards, arts. 5 – 18) and the LOREG 5/1985 (CHAPTER III – ELECTORAL ADMINISTRATION – SECTION I. ELECTORAL BOARDS, arts 8 – 21) put elections under the frame of a complex structure of Electoral Boards composed of Magistrates mainly from the provincial Audience (3: the President and 2 vocals) and well accredited professors (2) with an expertise in Law and Political Science.

Both articles constitute an anomaly in European Electoral Laws.

iii) LOREG 5/1985 has a long section on the roll of registrar of citizens which is obsolete too.  Arts.: 31 -41. It’s dark, It’s reading only casts shadows about the roll of citizens it rules about.

Art. 33. 1. reads: El censo electoral se ordena por secciones territoriales.

Key concerns  on LOREG 5/1985 and  the management of elections in the Kingdom of Spain can be summarized this way :

1. Destruction of Ballots (LOREG 5/1985, Article 97:3)

   – According to Article 97:3 of LOREG 5/1985, ballots are destroyed in the presence of polling station officials after they have been counted and recorded. This legal provision eliminates any opportunity for an independent recount or audit after the initial counting.

   – The destruction of ballots removes the primary evidence needed to verify the accuracy of the vote tally, especially in cases where discrepancies may be reported later. This practice leaves the electoral process vulnerable to errors or manipulation, and undermines trust in the final outcome.

   – After the aggregation of results by Indra, a judicial review is conducted by three judges and two professors who examine the same records that were transmitted from polling stations. However, without access to the original ballots, this review is limited to verifying the data already processed, with no means to check if the original vote counts were accurate.

   – This process raises concerns about whether the system is capable of catching errors or manipulation that may have occurred earlier in the counting and aggregation process.

4. Historical Context of Judicial Oversight

   – Given Spain’s history, including the lingering influence of Francoist judicial figures, there are concerns about the neutrality and independence of the judicial oversight in the electoral process. While this may be a sensitive issue, it is crucial that judicial bodies overseeing electoral integrity are perceived as fully independent and capable of ensuring fairness without bias or influence from political history.

In my experience, the lack of transparency and fairness in the electoral processes in Spain has contributed to an environment where political expression is often met with undue suspicion or hostility. This political atmosphere, exacerbated by flawed electoral processes, has personally affected me in several ways, leading to social stigmatization and legal challenges.

Conducting elections that don’t qualify for real, auditable elctions involves the violation of several Human Rights.
